Terms of Service

Please read these Terms carefully.

By creating an account, accessing, or using the Kynic platform (including website and mobile applications), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use Kynic.

1. Acceptance of Terms & Eligibility

Kynic is a social sports and team organisation platform operated in Australia. To register an account or use Kynic services:

  • You must provide accurate, current, and complete registration information.
  • Users under 18 years of age ("Minors") require explicit parent or legal guardian authorization. Minors must provide their parent or guardian's full name and email address during registration.
  • In accordance with Australian legal standards, a parent or legal guardian must review and counter-sign the digital guardian consent waiver before an under-18 user may create or join team fixtures.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

2. Platform Role & Sports Participation

Kynic provides digital logistics, team scheduling, availability tracking, and fee-splitting coordination tools. Kynic does not own, operate, or supervise the physical venues, pitches, competitions, or sporting matches organised by users.

  • Voluntary Sporting Participation: Players, coaches, and spectators acknowledge that participating in physical sports activities involves inherent risks of physical injury, illness, or property damage.
  • Assumption of Risk: Players voluntarily participate in matches organised via Kynic at their own risk and are encouraged to maintain appropriate personal sports injury insurance.
  • Venue & League Rules: Users must comply with all ground regulations, venue safety rules, and local council or league bylaws where matches take place.

3. Team Management & Match Fees

Kynic enables team admins and organisers to calculate and coordinate match subs, venue hire, and referee fees.

  • Transparency: Organisers agree to set fee amounts transparently for team members.
  • Third-Party Payment Processing: Digital payment transactions are processed via authorized third-party gateways (including Stripe). By utilizing digital fee splitting, you agree to comply with third-party payment terms and processing fees.
  • Dispute Exclusions: Kynic is not liable for personal cash disputes, uncollected cash subs, or private financial disagreements between individual team members and team organisers.

4. User Content & Acceptable Conduct

Kynic enforces a strict zero-tolerance policy against abusive behaviour, harassment, or unauthorized data scraping.

  • You agree not to post, send, or transmit abusive, offensive, defamatory, or unlawful content in squad chat or public team listings.
  • Scraping, harvesting, or collecting email addresses, phone numbers, or private contact details of other team members for commercial marketing or spam is strictly prohibited.
  • Kynic reserves the right to suspend or terminate any account violating conduct standards without prior notice.

5. Limitation of Liability & Recreation Waivers

To the maximum extent permitted by Australian Law, including the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and state recreational services legislation (including the Civil Liability Act 2002 (NSW)):

  • Kynic excludes all statutory guarantees, implied warranties, and liability for personal injury or death resulting from recreational sporting activities organised by independent users.
  • Kynic shall not be liable for indirect, incidental, special, or consequential damages, loss of profits, or data loss arising from platform usage.
  • Community organisers, coaches, and volunteers utilizing Kynic's digital waiver features are provided digital audit logs to record player consent and statutory risk notices.

6. Termination & Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for resolving any dispute relating to these Terms.
